1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Club Owner,” “Subscriber,” or “you”) and FUEGO PADEL LLC, a Limited Liability Company registered at the Qatar Financial Centre (“we,” “us,” or “our”), governing your use of the PadelLoc club listing subscription service at padelloc.com.
By subscribing to PadelLoc, you confirm that you are authorized to act on behalf of the club or business you are registering, that you are at least 18 years of age, and that you agree to be bound by these Terms.
2. Service Description
PadelLoc is a global directory platform for padel clubs. As a subscriber, your club listing is displayed on padelloc.com and made discoverable to players worldwide. PadelLoc is a directory service only. We do not process bookings, handle payments between clubs and players, or guarantee that listings will result in bookings or revenue.
3. Subscription Plans and Pricing
PadelLoc offers four listing tiers: Free ($0, basic listing with limited features), Pro ($29/month or $19/month billed annually at $228/year), Elite ($79/month or $59/month billed annually at $708/year), and FUEGO Connect (complimentary Elite-level listing included for clubs using FUEGO Hardware). All paid prices are in QAR equivalent, charged to your credit card via Dibsy (Paywise LLC). Your bank may apply currency conversion fees for non-QAR cards.
Annual subscriptions are billed upfront for the full year. Annual pricing represents a discount of up to 34% compared to monthly billing. We reserve the right to adjust pricing with 30 days written notice to active subscribers. Price changes do not affect the current billing cycle. Existing subscribers are grandfathered at their current rate if pricing increases.
4. Billing and Recurring Charges
Subscriptions are billed monthly in advance. Your first payment is processed at checkout via Dibsy’s secure hosted payment page with 3D Secure verification. Subsequent monthly charges are processed automatically using a secure payment token stored on our servers. You will receive an email receipt after each charge.
All prices are in QAR (Qatari Riyal). Your bank may apply currency conversion fees. Transaction fees charged by Dibsy are borne by FUEGO PADEL LLC, not by the subscriber.
5. Failed Payments and Grace Period
If a recurring charge fails (expired card, insufficient funds, or other reasons), we will notify you by email immediately. Your listing remains active for a grace period of 7 days. During the grace period, you can update your payment method via your account page. If no successful payment is received within 7 days, your listing will be deactivated. You can reactivate your listing at any time by updating your payment method and processing a successful payment.
6. Cancellation
You may cancel your subscription at any time from your account page on padelloc.com. Cancellation is self-service and requires one confirmation click. No cancellation fees apply. Upon cancellation, your listing remains active until the end of the current billing cycle. No further charges will be made after cancellation. Cancellations must be submitted at least 24 hours before the next billing date to avoid being charged for the next cycle.
7. Refunds
We offer a 7-day money-back guarantee from your first payment. If you are not satisfied within the first 7 days, contact support@padelloc.com for a full refund. After the initial 7-day period, subscriptions are non-refundable. No refunds are provided for partial months. Cancellation takes effect at the end of the current billing period. 8. Listing Content and Guidelines
8.1 Your Responsibilities
As a Club Owner, you are solely responsible for the accuracy and completeness of your listing content. You agree to: provide truthful and accurate information about your club (name, address, contact details, court specifications, opening hours); use only real photographs of your facility (no stock images, no images of other facilities); keep your listing information current and update it promptly when changes occur; ensure you have the right to use all content you upload (photos, logos, descriptions); and respond to inquiries from players in a timely and professional manner.
8.2 Prohibited Content
You may not post content that: contains false, misleading, or deceptive information; infringes on the intellectual property rights of any third party; contains offensive, discriminatory, hateful, or inappropriate material; promotes illegal activities or violates any applicable law; or contains malware, spam, or any form of automated content.
8.3 Our Rights
We reserve the right to: review and approve all listing content before publication; remove or modify listings that violate these guidelines without prior notice; suspend or terminate accounts that repeatedly violate these Terms; and feature selected listings in our marketing materials (with appropriate attribution).
9. Intellectual Property
The PadelLoc platform, including its design, code, branding, and original content, is the property of FUEGO PADEL LLC and is protected by applicable intellectual property laws.
You retain all rights to the content you upload to PadelLoc (photos, descriptions, logos). By uploading content, you grant FUEGO PADEL LLC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the PadelLoc platform and in promotional materials related to PadelLoc. This license terminates when you delete your content or cancel your subscription, except for content that has been shared or distributed prior to termination.
10. Limitation of Liability
To the maximum extent permitted by applicable law, FUEGO PADEL LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of PadelLoc, including but not limited to: loss of revenue, loss of bookings, unauthorized access to your account, errors or omissions in listing content, service interruptions or downtime, and actions of third parties including players or other clubs.
Our total liability for any claim arising from these Terms or your use of PadelLoc shall not exceed the total subscription fees you have paid to us in the 12 months preceding the claim.
11. Disclaimer
PadelLoc is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that: the service will be uninterrupted, error-free, or secure; listings will result in bookings, revenue, or any specific outcome; information provided by other users or clubs is accurate or reliable; or the platform will meet your specific business requirements.
12. Termination
We may suspend or terminate your account immediately, without prior notice, if you: breach these Terms; engage in fraudulent activity; post prohibited content; or fail to pay subscription fees after the grace period.
Upon termination, your listing is deactivated immediately. You remain liable for any outstanding fees. Provisions that should reasonably survive termination (intellectual property, limitation of liability, dispute resolution) shall survive.
13. Dispute Resolution
Any dispute arising out of or in connection with these Terms shall first be addressed through good faith negotiation between the parties. If the dispute cannot be resolved within 30 days of written notice, it shall be submitted to the exclusive jurisdiction of the QFC Civil and Commercial Court, Doha, Qatar.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws and regulations of the Qatar Financial Centre.
15. Amendments
We reserve the right to modify these Terms at any time. We will notify active subscribers of material changes by email at least 30 days before the changes take effect. Continued use of PadelLoc after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before the changes take effect.
